Cummins says it has reached a settlement agreement with JM Turbo Technology precluding the manufacture or sale of products that infringe the company’s registered patents. JM Turbo, which acknowledges that it illegally marketed and sold turbochargers protected by Cummins’ patents and other intellectual property rights registered in multiple countries, has agreed to stop all manufacturing, importation, exportation, advertising and/or sale of all infringing products. The settlement also calls for JM Turbo to destroy all existing inventory of the infringing products, the company says. Shon Wright, the company’s executive director and general manager for turbochargers, says that the company takes integrity seriously, and that it will continue to examine the marketplace to ensure that the company’s intellectual property is protected.
